Terms of Service

These terms govern your use of the GetKonnected platform and define the rights and responsibilities of both parties.

Important Notice

These Terms of Service constitute a legally binding agreement between you (or the company you represent) and GetKonnected. By accessing or using our services, you agree to be bound by these terms. If you do not agree, you must not use our services.

1. Acceptance of Terms

These Terms of Service ("Terms") apply to your access and use of the GetKonnected platform and services (collectively, the "Services"). By creating an account, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are accepting these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In such case, "you" and "your" will refer to that entity.

UK-Based Service: GetKonnected is provided from the United Kingdom and governed by UK law. These Terms comply with UK regulations including GDPR, the Data Protection Act 2018, and applicable health and safety legislation.

2. Service Description

GetKonnected provides an all-in-one cloud-based platform that helps facilities-management and field-service companies take control of their operations. Our Services bring jobs, teams, suppliers, safety documentation, and financial tracking into one connected workspace, including:

Job & Workforce Management

Plan, schedule, and coordinate work from creation to completion with real-time progress tracking, team coordination, and approval workflows.

Compliance & Safety

Manage compliance documentation including RAMS, SSOW, COSHH, asset registers, and incident reporting with full audit trails and automated document generation.

Financial Integration

Track financial data directly linked to jobs and projects with comprehensive reporting and visibility across every aspect of your operations.

AI-Powered Automation

Leverage built-in automation and AI assistance to generate professional documents, analyze performance, and maintain compliance with minimal effort.

The platform integrates with Microsoft 365 and email systems to streamline communication and reporting, and scales seamlessly for multiple teams and clients. We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice to users.

2.5 Mobile Applications

The Services include mobile applications distributed through the Apple App Store and Google Play Store (the "Mobile Apps"). The Mobile Apps provide access to the GetKonnected platform under your existing subscription and are subject to these Terms in addition to any applicable terms of the relevant app store. Your subscription, billing, and account management are handled by GetKonnected directly - the Mobile Apps do not contain in-app purchases, and no payments are taken through the Apple App Store or Google Play.

3. User Accounts and Responsibilities

3.1 Account Registration

  • You must provide accurate, current, and complete information during registration
  • You must maintain and promptly update your account information
  • You are responsible for maintaining the confidentiality of your login credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized access or security breach
  • You must be at least 16 years old to use the Services. The Services are intended for professional use and are not designed for children. By creating an account, you represent and warrant that you meet this minimum age requirement.

3.2 Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable laws
  • Upload or transmit viruses, malware, or any other malicious code
  • Attempt to gain unauthorized access to our systems or other user accounts
  • Interfere with or disrupt the integrity or performance of the Services
  • Reverse engineer, decompile, or disassemble any part of the Services
  • Use the Services to store or transmit infringing, defamatory, or unlawful content
  • Share your account credentials with others or allow multiple users to access a single account

3.3 User Permissions

As the account owner, you are responsible for managing user permissions and access levels within your organization. You must ensure that users only have access to information necessary for their role and comply with applicable data protection regulations.

4. Data Ownership and Privacy

Your Data Belongs to You

All content, data, and information you upload, create, or store within the Services (collectively, "Customer Data") remains your property at all times. This includes:

  • • Risk assessments and safety documentation
  • • Employee and contractor records
  • • Incident reports and safety observations
  • • Asset and vehicle information
  • • All other business data you input into the platform

4.1 Data Isolation

Each company account has a completely separate and isolated database. Your data cannot be accessed by other GetKonnected customers. We implement strict technical and organizational measures to ensure data isolation and security.

4.2 Our Limited License

You grant us a limited license to use your Customer Data solely to:

  • Provide and maintain the Services
  • Process data using AI tools at your request
  • Troubleshoot issues and provide technical support
  • Comply with applicable laws and regulations

We will never use your Customer Data to train AI models, sell to third parties, or for any purpose other than providing the Services to you.

4.3 Data Export and Portability

You may export your Customer Data at any time in standard formats. Upon termination of your account, you will have a reasonable period (typically 30 days) to export your data before it is deleted.

4.4 Privacy Compliance

Our processing of personal data is governed by our Privacy Policy and complies with UK GDPR and the Data Protection Act 2018. You are responsible for ensuring your use of the Services complies with all applicable data protection laws.

5. Payment Terms

5.1 Subscription Fees

The Services are provided on a subscription basis. Fees are based on your selected plan and are payable in advance on a monthly or annual basis as specified in your subscription.

5.2 Billing and Payment

  • You authorize us to charge your designated payment method for all applicable fees
  • All fees are exclusive of VAT and other applicable taxes
  • Subscriptions automatically renew unless cancelled before the renewal date
  • Failed payments may result in suspension or termination of Services
  • All subscription billing is handled by GetKonnected directly through our website. The Mobile Apps do not offer in-app purchases or subscriptions through the Apple App Store or Google Play, and no fees are charged through those stores

5.3 Price Changes

We may change our pricing with 30 days' notice. Price changes will apply from your next renewal date. If you do not agree to a price change, you may cancel your subscription before the new price takes effect.

5.4 Refunds

Fees are non-refundable except as required by law or as expressly stated in these Terms. If you cancel a paid subscription, you will continue to have access to the Services until the end of your current billing period.

6. Intellectual Property Rights

6.1 Our Rights

GetKonnected and its licensors own all rights, title, and interest in and to the Services, including all software, technology, designs, graphics, trademarks, and other intellectual property. These Terms do not grant you any ownership rights to the Services.

6.2 Your Rights

You retain all rights to your Customer Data. We claim no intellectual property rights over the content you upload or create using our Services.

6.3 AI-Generated Content

Content generated by AI tools within the Services is provided to you for your use. You are responsible for reviewing, validating, and approving all AI-generated content before use. We make no warranties regarding the accuracy or suitability of AI-generated content for your specific needs.

6.4 Feedback

If you provide us with feedback, suggestions, or ideas about the Services, you grant us a perpetual, worldwide, royalty-free license to use and incorporate such feedback into our Services without compensation or attribution to you.

7. Mobile App Terms

7.1 Licence Grant

Subject to your compliance with these Terms and your active subscription, GetKonnected grants you a limited, non-exclusive, non-transferable, revocable licence to install and use the Mobile Apps on a device that you own or control, solely for the purpose of accessing the Services on behalf of your organisation.

7.2 Apple App Store - Additional Terms

These Terms are an agreement between you and GetKonnected Ltd, and not with Apple. For iOS, GetKonnected grants you a limited, non-exclusive, non-transferable, revocable licence to use the Mobile App on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions and App Store Usage Rules.

GetKonnected is solely responsible for maintenance and support, warranties to the extent required by law, and investigating, defending, settling, and discharging product claims, claims that the Mobile App fails to comply with applicable legal or regulatory requirements, and third-party intellectual property claims. You must comply with all applicable export control and sanctions laws. Apple and its subsidiaries are third-party beneficiaries of this Section and, upon your acceptance of these Terms, have the right to enforce this Section against you.

7.3 Google Play - Additional Terms

The Google Play distribution of the GetKonnected app is also subject to the Google Play Terms of Service. Where those terms govern your use of Google Play itself, they control. These Terms govern your use of the GetKonnected Services.

7.4 Export Compliance

You confirm that you will use the Mobile Apps in compliance with all applicable export control and sanctions laws of the United Kingdom, the European Union, and the United States, and that you will not use, export, or re-export the Mobile Apps to any prohibited destination or party.

8. Service Availability and Support

8.1 Uptime and Availability

We strive to maintain high availability of the Services but cannot guarantee uninterrupted access. Planned maintenance will be communicated in advance where reasonably possible.

8.2 Support

We provide technical support via email at admin@getkonnected.dev. Support response times vary based on your subscription plan. We will use commercially reasonable efforts to respond to support requests promptly.

8.3 Service Modifications

We may modify, update, or discontinue features of the Services at any time. We will provide reasonable notice for material changes that negatively affect your use of the Services.

9. Termination

9.1 Termination and Account Deletion by You

  • Cancel your subscription: You may cancel your paid subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing period.
  • Delete your individual user account: You may delete your individual user account at any time via Settings -> Account -> Delete Account within the app. If you cannot access the app, email admin@getkonnected.dev from your registered email address to request deletion. The deletion process and what is and isn't retained is described in our Privacy Policy.
  • Delete your organisation's account: Account administrators may request full deletion of the organisation's account, including all Customer Data, by contacting admin@getkonnected.dev. We will action verified requests within 30 days, subject to the data export period set out in Section 9.3.

9.2 Termination by Us

We may suspend or terminate your account if:

  • You breach these Terms
  • Your payment method fails and you do not update it within a reasonable time
  • Your use of the Services poses a security risk or violates applicable laws
  • We are required to do so by law or regulatory authority

We will provide reasonable notice before termination unless immediate termination is required by law or to prevent harm.

9.3 Effect of Termination

Upon termination, your right to use the Services immediately ceases. We will provide you with a reasonable opportunity (typically 30 days) to export your Customer Data. After this period, your data will be securely deleted from our systems in accordance with our data retention policies.

10. Warranties and Disclaimers

10.1 Our Warranties

We warrant that the Services will perform substantially in accordance with our published documentation. If the Services do not conform to this warranty, we will use commercially reasonable efforts to correct the non-conformity.

10.2 Disclaimer

Important Legal Notice

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE ARE NOT LIABLE FOR ANY THIRD-PARTY SERVICES OR CONTENT ACCESSED THROUGH THE SERVICES.

10.3 Your Responsibilities

You are solely responsible for ensuring that AI-generated content, risk assessments, and other safety documentation meets your specific requirements and complies with applicable health and safety regulations. We provide tools to assist you, but you remain responsible for the accuracy and adequacy of all safety documentation produced using our Services.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GETKONNECTED, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

  • • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • • LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
  • • BUSINESS INTERRUPTION OR LOSS OF GOODWILL
  • • ANY DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICES

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless GetKonnected and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Your Customer Data or use of the Services
  • Infringement of any third-party rights by your Customer Data
  • Unauthorized access to your account due to your failure to maintain security

13. Copyright and Content Complaints

If you believe content uploaded to the Services by another user infringes your copyright or other intellectual property rights, please send a written notice to admin@getkonnected.dev including:

  • Your contact details
  • A description of the work you claim has been infringed
  • The location within the Services of the allegedly infringing material
  • A statement that you have a good-faith belief that the use is not authorised
  • A statement, under penalty of perjury, that the information is accurate and that you are authorised to act on behalf of the rights holder

We will review and act on valid notices in line with applicable law, which may include removing the content and notifying the affected account.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

14.2 Jurisdiction

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation (including non-contractual disputes or claims).

14.3 Dispute Resolution

Before filing any legal action, we encourage you to contact us at admin@getkonnected.dev to seek a resolution. We will work in good faith to resolve disputes amicably and promptly.

15. General Provisions

15.1 Changes to Terms

We may modify these Terms from time to time. We will notify you of material changes via email or through the Services. Your continued use of the Services after such notification constitutes acceptance of the modified Terms.

15.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GetKonnected regarding the Services and supersede all prior agreements and understandings.

15.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.4 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

15.5 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

15.6 Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or governmental actions.
